Courts Fen-phen case goes to jury COVINGTON – The fate of three lawyers accused of looting a $200 million settlement intended for 440 Kentuckians sickened by the diet drug fen-phen is in the hands of the jury. The case went to the jury at 9:20 a.m. this morning after U.S. District Judge William Bertelsman finished reading instructions to the jury in a trial that started on May 12. Jurors sent a note to Bertelsman a short time later asking for a calculator, flip chart and an index of the hundreds of exhibits presented at the trial. During the trial, federal prosecutors presented evidence that the lawyers who represented the 440 people – Shirley Cunningham Jr., William Gallion and Melbourne Mills Jr. – were entitled to about $60 million in fees, but took an additional $45 million and put another $20 million into a charity they created and controlled.
